Civil Rights and Constitutional Law:

Arthur v. Starrett City Assocs., Et Al., 79 C 3096 (E.D.N.Y.) (a
civil rights class action challenging discrimination in the processing
of applications to federally subsidized apartments. Contrary to
defendants’ contention, HUD established its policy as barring
discrimination in the allocation of apartment units, including to
avoid tipping). (My letter on HUD’s policy and regulation was cited
in other cases, became the statement of HUD’s formal position and
the basis for subsequent enforcement actions.)

*Board of Education v. Califano (I), 584 F. 2d 576 (2d Cir. 1978),
aff'd sub. nom. Board of Education v. Harris, 444 U.S. 130, 100 S.
Ct. 363, 62 L. Ed.2d 275 (1979) (standards of  ineligibility for grant
under the Emergency School Aid Act).

Board of Education v. Califano (II), 464 F. Supp. 1114 (E.D.N.Y.),
aff'd sub nom. Board of Education v. Harris, 622  F. 2d 599 (2d Cir.
1979), cert. denied, 449 U.S. 1124 (1981) (standards for obtaining
a waiver of ineligibility under the Emergency School Aid Act).

Caulfield v. Board of Education, 449 F. Supp. 1203 (E.D.N.Y.),
rev'd in part, 583 2d 605 (2d Cir. 1978),  on remand, 486 F. Supp.

(religious dispute between factions of a Hassidic Congregation
alleged as violations of RICO).

Cruz v. Tyson Foods, Inc., Civil Action No. 02 C 2761 (N.D. Ill.)
(civil RICO action based upon alleged conspiracy involving theft of
identities to hire illegal aliens and evade INS detection).

Goldberg v. Weinberger, 546 F. 2d 477 (2d Cir. 1976), cert.
denied, 431 U.S. 937 (1977) (challenge to the constitutionality of
limitations to Social Security benefits for widows who remarry).

Green Party of N.Y.S. v. N.Y.S. Board of Elections, Docket No. 03-
7679 (2d Cir. Nov. 17, 2004)(action to enjoin State’s
disenfranchisement of minority parties whose Gubernatorial
candidate failed to get 50,000 votes in last election).

Grundman v. Trans World Airlines, Inc., 87 Civ. 8927 (S.D.N.Y.)
(action for  employment age discrimination - coerced resignation).

Hansen v. State of Oregon, 90-6341 (D.Or.) (action to redress
violations of civil and constitutional rights arising from unlawful
search).

*Jamaica Savings Bank v. Lefkowitz, 390 F. Supp. 1357 (E.D.
N.Y.),  aff'd, 423 U.S. 802 (1975) (challenge under the Contract
Clause to state requirement of interest payments on escrow
accounts).

Katcoff v. Alexander, 599 F. Supp. 987 (E.D.N.Y. 1980), 582 F.
Supp. 463, aff’d in pt. and revd. in pt., 755 F.2d 223 (2d Cir. 1985)
(challenge to the constitutionality of the Army's chaplaincy program).
Malhotra v. Cotter & Company, Docket No. 90-3862 (7th Cir.)        
(appeal to determine post Patterson standard for denials of
promotion actionable under 42 U.S.C. Section 1981).

*McRae v. Harris, 491 F. Supp 630 (E.D.N.Y.), rev'd, 448 U.S.
297 (1980)(challenge to the constitutionality of congressional
limitations to medicaid  funding of abortions).

*NOW v. Scheidler, 86 C 7888 (N.D. Ill.), remanded, 510 U.S.249
(1994), on remand, 267 F.3d 687 (7th Cir. 2001), reversed sub
nom., Scheidler v. NOW, 537 U.S. 393, 123 S. Ct. 1057, 154 L.
Ed. 2d 991 (2003) (Civil RICO action against abortion protestors
based on alleged predicate acts of extortion). Supreme Court’s
decision was reviewed in 188 America No. 12, “Scheidler v.
NOW: The Supreme Court and public Protest,” pp. 18-21 (April 7,
2003).

Turkmen v. Ashcroft, 02 Civ. 2307 (E.D.N.Y. ) (John Gleeson, D.J.)
(pending): Bivens action against federal officials and the United
States for alleged violations of constitutional rights of persons
arrested, held in detention and deported for violations of
Immigration laws after 9/11.

Verdell v. Kocher, 76 C 908 (E.D.N.Y.) (Title VII class action for
systemic racial employment discrimination).

United States v. Alaw, 98 CV 01446 (D.D.C.), affirmed sub nom.,
United States v. Mahoney,  246 F.3d 279  (D.C. Cir. 2001), on
remand, 180 F. Supp. 2d 197 (D.C.D.C. 2001), rev’d in part, 327 F.
3d 1217 (D.C. Cir. 2003) ( civil FACE action against pro-life
protestors raising statutory issues of first impression and significant
constitutional issues, including vagueness and over breath of civil
injunction).

United States v. Board of Education, 76 C 861 (E.D.N.Y.), appeal
dismissed as moot, 543 F. 2d 1 (2d Cir. 1976) (action to compel
disclosure of  racial, ethnic, and sex data, and related contempt
actions).

United States v. Cohen, 796 F.2d 20 (2d Cir. 1986), cert. denied,
